Like you say player welfare has to trump everything else, especially with the law suit cases going on at the moment, but there is no one fit for it.

Very delayed reply here but I would say if the ref doesn't spot it at the time and it goes to a review, then the chance for a penalty is lost as the game can't be brought back. The review would just be to dole out any warranted punishment to the offending player
