ECHR met Armenia’s claims, Prosecutor’s Office states

Yerevan /Mediamax/. Armenian Prosecutor General’s Office stated that ECHR met all Armenia’s claims on the case of "Perincek v. Switzerland”.

According to the official website of the Prosecutor General’s Office, as a third party, Armenia expected the European Court to rule out the statements from the judgment that could in any way call into question the fact of the Armenian Genocide.

“European Court stated in today’s judgment that this decision is not meant to determine whether or not the mass massacres and deportations of Ottoman Empire against Armenia can be qualified as genocide under its definition by international law. Grand Chamber of the Court further posited that the Court is not authorized to make legally binding statements on this issue, regardless of the perspective.

Besides, the Court noted in the judgment that Armenians have the right to respect their and their ancestors’ dignity including the identity of Armenian community affected by the Armenian Genocide. The Court also stated that the Armenians' assertions and dignity are due to be defended within the scope of the conventional standards'', said the Prosecutor's Office.

Finally, regarding Perincek's case, the Court defined that his persecution doesn't contradict the European Court Case Law, but it is a wrong enforcement of the Swiss law. In other words, criminalization of Armenian Genocide denial and subsequent persecution has been considered appropriate, but that should be done exclusively within the framework of the European Convention’’, the Prosecutor's Office noted.
