Kazakhstan to ban creation of fully autonomous AI

Tengrinews.kz - A separate law on artificial intelligence (AI) will be introduced in Kazakhstan. Today, deputies of the Mazhilis adopted the corresponding document for work.
Mazhilis deputy Yekaterina Smyshlyayeva published the "skeleton" of the bill, which sets out the main innovations of the future law on AI. We will tell you about the most interesting ones.
AI systems will be divided into 3 categories
The first category is auxiliary artificial intelligence systems (assistants). Here, AI acts as an assistant. The final decisions are made by the user.
The second category is semi-autonomous systems. In them, the user gives AI limited rights to automated decision-making within pre-set parameters. At the same time, a person can intervene in the decision-making process or change the results of the system's activity.
The third category is fully autonomous systems - they make decisions regardless of pre-set parameters and are not subject to control by the owner of this system.

"The creation and release of fully autonomous artificial intelligence systems into circulation is prohibited on the territory of Kazakhstan," the document says.

Also subject to the ban are AI systems with the following functions:

the use of subconscious, manipulative or other methods that significantly distort human behavior and limit the ability to make conscious decisions or force them to make decisions that may harm a person or create a threat of harm to life, health and property;
the use of a person's moral or physical vulnerability due to age, disability, social status and any other circumstances in order to cause or create a threat of harm to him;
determining a person's emotions without his consent, except for cases stipulated by the laws of Kazakhstan;
remote biometric identification of people in real time in public places, except for cases specified by the laws of Kazakhstan;
assessment and classification of people over a certain period of time based on their social behavior or known, assumed or predicted personal characteristics.

The bill also plans to create a national artificial intelligence platform and data libraries.
Kazakhstanis will be able to insure themselves against AI risks
According to the developers of the bill, compensation for damage caused by artificial intelligence systems will be carried out in the manner determined by the Civil Code.

"Insurance of liability for damage caused by artificial intelligence systems and risks associated with the use of AI systems is carried out on a voluntary basis in accordance with the legislation of Kazakhstan on insurance and insurance activities," the document says.

It is also noted that liability will be provided for violation of legislation in the field of AI. What kind - has not yet been specified. If the law is adopted, it will enter into force after 60 calendar days.
On February 5, the bill on AI entered the Mazhilis, the deputies accepted it for work.
Earlier, at the plenary session of the international digital forum Digital Almaty 2025, Prime Minister of Kazakhstan Olzhas Bektenov announced the creation of the AI ​​Committee, the development of a bill on artificial intelligence and a national AI strategy. The AI ​​bill, he said, is aimed at creating a legal basis for the development of innovation. The document should also ensure a balance between regulation and stimulation of the development of the AI ​​sphere.
