Trump May Dump Liberal American Bar Association From Evaluating Judicial Picks

0

President Donald Trump may dump the American Bar Association, as the increasingly liberal organization gives bad ratings to conservative judicial nominees.

Republicans are rightfully fed up with the American Bar Association (ABA) sticking its nose into the judicial nominee process, and they’re demanding that President Trump cut ties with the group entirely.

For years, conservatives have watched as the ABA, a supposedly neutral legal organization, has revealed its blatant liberal bias time and again. Its ratings of judicial nominees often seem less about qualifications and more about pushing a progressive agenda, which is why GOP figures like Senators Mike Lee and Ted Cruz are leading the charge to ditch this relic of the establishment, saying it’s about time someone stood up to these unelected gatekeepers.

The ABA’s track record speaks for itself, and it’s not pretty if you value constitutional principles.

Back in 2001, the Bush administration wisely sidelined the group after it gave low marks to conservative nominees who later proved to be stellar judges. Fast forward to Trump’s first term, and the ABA was at it again, slapping a “not qualified” label on Ninth Circuit nominee Lawrence VanDyke—only for the Senate to confirm him anyway.

This isn’t about competence; it’s about politics, Republicans say. The ABA’s pattern of favoring left-leaning jurists while undermining originalists and textualists is a slap in the face to the rule of law.

Now, with Trump back in the White House, conservatives see a golden opportunity to break free from the ABA’s stranglehold once and for all.

A letter signed by 24 Republican senators makes it crystal clear: they want the ABA out of the vetting process for judicial nominees. Why should a private organization with a clear ideological slant have any say in who interprets our Constitution? The Founding Fathers didn’t envision some elitist lawyer club playing kingmaker, and neither should we, they say. This is about restoring power to the people’s elected representatives, not ceding it to a biased third party.

The pushback against the ABA isn’t just about optics—it’s about principle.

Conservatives argue that the group’s “peer review” process is a sham, often relying on anonymous feedback that reeks of backroom deals and partisan score-settling.

Take Leonard Leo of the Federalist Society, a key player in Trump’s judicial strategy, who’s called out the ABA for its lack of transparency and accountability. When you’ve got a system that hides behind secrecy while trying to tank solid conservative nominees, it’s no wonder trust in the ABA is at rock bottom among the right.

On the flip side, liberals and their allies in the ABA will cry foul, claiming this move undermines the integrity of the judiciary. But the ABA’s “integrity” has been a cover for advancing progressive causes—like abortion—through the courts for decades. Conservatives aren’t buying the sob story. They see this as a chance to level the playing field and ensure judges are picked based on their fidelity to the Constitution, not their ability to appease a left-wing legal clique.

Trump’s team seems to be listening.

Reports suggest the administration is already leaning toward scrapping the ABA’s role, just as it did in 2017 when the group was sidelined for Supreme Court picks like Neil Gorsuch and Brett Kavanaugh. Those justices turned out just fine without the ABA’s stamp of approval, proving the point that conservatives have been making all along: the ABA isn’t some indispensable gold standard—it’s a dispensable roadblock. If Trump follows through, it’ll be a win for judicial independence and a blow to the entrenched liberal elite.

At the end of the day, this fight is bigger than the ABA itself—it’s about who gets to shape America’s future. Conservatives know the judiciary is ground zero in the battle over our nation’s values, from protecting the unborn to defending the Second Amendment. By kicking the ABA to the curb, Republicans are sending a message: no more playing nice with institutions that despise our principles. With Trump at the helm and a Senate ready to back him, the stage is set for a conservative judicial revolution—and not a moment too soon.
