Court will not interfere in decision in Warren Mottley Inquest

The court will not interfere with the decision rendered by coroner Graveney Bannister into the death of Warren Mottley, brother of Prime Minister Mia Mottley.

This was the decision handed down this morning by High Court Judge Patrick Wells.

“When litigants establish claims of merit on the facts and/or law, they must be copiously given every sinew of any remedies to which they are rightfully entitled. Equally, when such Claimants fail so to do, the court must be careful, diligent, and astute not to abuse its authority and its discretion in making orders to which a litigant is not justly entitled,” he said.

Wells dismissed the claim for judicial review and refused all orders sought. He ruled that all proceedings in the inquest should stand; the verdict should remain undisturbed and injunctions granted in the High Court should be fully discharged, and costs – still to be assessed – would be awarded to the defendants.

The High Court had also granted an interim injunction in favour of surgeon Dr Sahle Griffith which prevented the authorities from charging him criminally in the death of Mottley.

On December 23, 2023, Bannister ruled that there was gross negligence by Griffith, the principal doctor at Surgical Solutions Limited, and his junior, anaesthesiologist Dr Nigel Farnum, that precipitated the death of Mottley.

Additionally, he found there was a failure to diagnose or misdiagnose and a failure to properly treat Mottley’s infection. Mottley went into Surgical Solutions for a colonoscopy, a routine procedure, but he did not come out.

Dr Griffith’s legal team which comprised Senior Counsels, Ralph Thorne and Hal Gollop had asked the High Court to conduct a judicial and to invalidate the Coroner’s Inquest into the death of Warren Mottley.

They said this morning that they would appeal the decision.
