Man cleared of rape suing state

A former rape accused, who was acquitted of the offence after a trial, is contending that police sullied his reputation when they charged him without any meaningful investigation.

Lionel DaCosta Wilson is now asking a High Court to award him costs and damages as a result.

Wilson, of Long Bay, St Philip, was charged with raping a 73-year-old woman on August 13, 2016. He maintained his innocence and, after a trial, was found not guilty in October 2020.

Through his attorney Lalu Hanuman, he has now sued the Attorney General and has asked a civil court to declare that there has been unreasonable delay in breach of Articles 11 (c) and (18) of the Constitution, and a declaration that there has been a breach of Article 11 (c) in that police ought not to have charged him without adequate evidence.
