Nauman Hussain appeal denied in Schoharie County limo crash case

ALBANY, N.Y. (NEWS10) -- According to the New York State Supreme Court Appellate Division, Nauman Hussain will remain in prison after the court denied his bid to overturn his conviction. Hussain was the operator of the company involved in the October 2018 limo crash in Schoharie County.

The crash killed 20 people, leading to 20 counts of manslaughter for Hussain. The defendant's legal team argued he was deprived of his right to a fair trial and his sentencing was too severe.

The court said the sentence of five to 15 years "reflects the grievous harm caused by his recklessness and his callousness."

NEWS10 received a statement from Hussain's attorney, Steven Sharp, stating the following: "While we respect the Court’s decision, we disagree with it’s ultimate conclusion. The Third Department agrees the court abused its discretion in only affording Nauman 20 minutes to consider the enhanced sentence sprung on him at the last minute. Unfortunately, today’s decision means there is no remedy for such an abuse. We do not believe that should be the law and hope the Court of Appeals will see fit to address this issue.”
