Prosecutor tells jury that veteran showed 'indifference' to man he choked to death on subway
Opening statements have started in the trial of Daniel Penny, the white veteran accused of choking a distressed Black subway rider to death. Prosecutors started delivering their opening Friday in the case surrounding Jordan Neely’s 2023 death. Prosecutor Dafna Yoran said Penny didn’t intend to kill Neely, but that Penny’s efforts to neutralize what he saw as a threat “went way too far." Penny claims he acted in self-defense. The case has rattled fault lines surrounding race, homelessness, perceptions of public safety and bystanders’ responsibility. Jurors could hear some witness testimony Friday after opening statements.
