FEC slams 'frivolous' lawsuit by House Dems over alleged GOP campaign finance loophole

The Federal Elections Commission hit back at House Democrats calling their lawsuit "frivolous" as they accuse the agency of allowing Republicans to use a loophole in campaign finance laws.

Democrats say the GOP is funding campaign ads using a tactic that the FEC hasn't ruled on yet, Axios reported Thursday. The FEC has been deadlocked on party lines, so the GOP has continued the practice.

The Republican Party has made ads that resemble attacks "but which are paid for by joint fundraising committees as if they are fundraising ads," according to Axios. "It has been a key strategy for conservatives, who are trying to capture majorities in both chambers while being outspent and outraised."

Republicans claim that Democrats like Kamala Harris and Hillary Clinton have used similar strategies in the past. If the DCCC prevails in the lawsuit, it could put a stop to many GOP ads airing in the next few weeks.

"I fully expect the FEC to prevail in this frivolous lawsuit. We will see the DCCC in court," FEC Chairman Sean Cooksey told Axios.
