Trump attorney Alina Habba expects to be hit with 'onslaught of litigation' before election

Trump lawyer Alina Habba said in an interview Thursday that she expects to be hit with an "onslaught of litigation" with less than 35 days until the presidential election.

Habba made the remarks in the context of comments about special counsel Jack Smith's 165-page filing that was unsealed Wednesday by a Washington, D.C., federal court. Trump's campaign has argued Smith's prosecution over Trump's actions on Jan. 6, 2021, are political.

Habba in the interview with Jesse Watters of Fox News called the actions by DOJ an act of "desperation."

"The Department of Justice has been complicit, and we've said this numerous times, but American pay attention: we have 30 plus days until an election. We are going to be hit with an onslaught of fake news. We are going to be hit with an onslaught of litigation," Habba told Waters.

"We have to understand one thing: this is called desperation," Habba added.

The 165-page filing on Wednesday revealed new details on the former president’s efforts to sway election officials in key swing states to overturn their states’ election results in his favor.

The filing laid out a pathway for Smith's election interference case against Trump after the Supreme Court determined that former presidents retain immunity when exercising core constitutional powers and are presumptively immune for all other official acts.

Trump has repeatedly railed against Smith's case and argued that he is a political victim, though there has been no evidence that President Biden or Vice President Harris have interfered with Smith.
