'Utterly failed': Judge tosses Giuliani's defamation suit against President Joe Biden

A federal judge tossed former Donald Trump attorney Rudy Giuliani's lawsuit against President Joe Biden because it "utterly failed" to prove a crucial point, court records show.

New Hampshire judge Paul J. Barbadoro dismissed Giuliani's defamation lawsuit Friday on the grounds that the former New York City mayor had failed to prove the court had jurisdiction over the U.S. president.

"When personal jurisdiction is challenged, the plaintiff 'must carry the burden of showing that personal jurisdiction is both statutorily authorized and consistent with the constitutional requirements of due process,'" Barbadoro wrote.

"Giuliani has utterly failed to carry this burden."

The former New York City mayor filed suit against Biden in October 2023 over the president's claim during a 2020 presidential debate that Giuliani was distributing Russian misinformation.

"He’s being used as a Russian pawn," Biden said. "He’s being fed information that is Russian, that is not true."

Giuliani reportedly filed his defamation lawsuit in New Hampshire to take advantage of the state's defamation laws, according to previous reporting from CNN.

The former mayor himself faced a high profile defamation case from Georgia election workers Ruby Freeman and Shaye Moss, the mother and daughter who won a $148 million verdict against him in Washington D.C. federal court last year.

Giuliani was sued after he claimed that the two women rigged the 2020 presidential election. He continued to make the claims during the trial.

The New Hampshire federal judge dismissed Giuliani's case without prejudice and maintained the former mayor's right to refile in a court that does have jurisdiction.
