Jimcy McGirt charged with one felony & two misdemeanors amid sex offender violations
WEWOKA, Okla. (KFOR) — The man behind the controversial "McGirt Ruling" is back in court.
Earlier this month Jimcy McGirt was arrested by Seminole Lighthorse Police after he allegedly approached two children near a playground.
On Tuesday, McGirt appeared via Zoom in the Seminole Nation District Court in Wewoka.
His attorney Robert O'Connell spoke on his behalf telling the judge that McGirt would "stand mute" on his charges, meaning he will not enter a plea.
"I like the accusations, the nature of them, and I think there's a lot to work with," said O'Connell. "He told the police at the scene that he wasn't talking to children, that there was no wheelchair found, Jim is able bodied. That was a just some foolishness from some children."
McGirt decided to "stand mute" on his charges and his lawyer told News 4 he has no doubt they will be able to fight this case.
The charges include unlawfully residing within 2,000 feet of a park, and two misdemeanors — one for failing to register as a sex offender and another for providing misleading information on his registration.
O'Connell said the evidence doesn't add up.
"I don't feel they've stated the cause of action on count one or count two and how three is a misdemeanor, but we'll see, and it's going to be up to the judge, the case will be tried in a courtroom," said O'Connell.
McGirt is scheduled to be back in court for a preliminary hearing on October 15.
