Judge Chutkan gives MAGA rioter 19 months behind bars for assaulting cops at the Capitol

U.S. District Judge Tanya Chutkan handed down a 19-month prison sentence to a Jan. 6 rioter who assaulted police officers at the U.S. Capitol, according to CBS News' Scott MacFarlane.

Kyle McMahan, a Reservist Air Force Staff Sergeant from Wautoga, Texas, was arrested last year on a series of felony and misdemeanor charges in the insurrection.

McMahan was identified through open-source video as being among rioters unlawfully on Capitol grounds and in the building on Jan. 6, 2021, the Justice Department said in a news release at the time.

McMahan wore a tan jacket, blue neck gaiter, backpack, ballistic helmet, and red MAGA hat with the word "GOD" written on it in marker, and was seen at the front of a group of rioters confronting law enforcement officers. He appeared to initiate four separate physical encounters with four different officers. A video from outside the Capitol showed McMahan pushing back and forth against an officer moments after a crowd tried to enter the east doors, authorities said.

McMahan pleaded guilty in June to assaulting law enforcement officers.

Chutkan, who is best known for overseeing the federal election conspiracy case against former President Donald Trump brought by special counsel Jack Smith, has also presided over a number of Jan. 6 cases, due to her seat being located in Washington, D.C. On at least some occasions, she has fought to contain her frustration at rioters' behavior during sentencing.

Around 1,300 people have been arrested in connection with the Jan. 6 attacks, which sought to violently shut down a session of Congress certifying President Joe Biden as the winner of the 2020 election. These cases range from misdemeanor trespassing and disorderly conduct, to seditious conspiracy charges against higher-ups in the far right Proud Boys and Oath Keepers groups.
