Oakland man gets house arrest, probation for jumping BART fare gate with gun reportedly used in Hayward homicide

OAKLAND — A local resident has been sentenced to 180 days of house arrest and a two-year probation term after pleading no contest to possessing a gun that BART police found on him after he jumped a fare gate, court records show.

Deronne Taylor, 26, pleaded no contest to being a felon in possession of a firearm and was formally sentenced in late July, records show. Prosecutors say that back in October, Taylor jumped a BART fare gate and was promptly detained by an officer who found an unserialized semi-automatic pistol in Taylor’s possession.

Authorities say that a ballistics test confirmed that just 15 hours before Taylor’s arrest, that same gun had been used to kill 43-year-old Oscar Geovany Baires Martinez outside of a liquor store at B and Alice streets in Hayward. Another person was injured in the shooting but survived. No one has been charged in Baires Martinez’s death, but the investigation remains active.

Taylor spent roughly four days in jail after his October arrest, and has been out of custody ever since, court records show. Last year, Taylor’s lawyer filed a legal motion accusing BART police of conducting an illegal search.

Taylor was not allowed to possess guns because of a prior felony conviction for carrying a loaded gun in public, court records show.
