Pro-Life Advocates Celebrate Ruling Upholding Nebraska Law Saving Babies From Abortions
Planned Parenthood’s attempt to tear down Nebraska’s protections for minor children and preborn babies was thwarted in the state’s Supreme Court with a decision handed down on July 26, 2024. The court upheld the constitutionality of a state law limiting abortions to the first twelve weeks of pregnancy and protecting minors from underage transgender surgeries. The decision allowing the law to stand comes after the court’s consideration of the issue. The only submitted amici curiae brief upholding the law presented legal arguments by Thomas More Society attorneys on behalf of two Nebraska State Senators, Kathleen Kauth and Joni Albrecht.
The abortion business represented by the ACLU, claimed that the legislative bill (LB574) violated Nebraska’s single-subject rule. This allegation was strongly contested by the brief submitted by Thomas More Society in support of the State of Nebraska and the intent of its legislature.
Thomas More Society attorneys demonstrated that Nebraska’s treatment of family protections as a broad single subject is solidly in the mainstream and completely in step with the way that the majority of state supreme courts across the country have treated the issue.
The amici brief also called attention to “the unnecessary complication caused by Planned Parenthood’s disregard for plain language in this Court’s prior decisions.”

The law upheld by the court has prohibited abortion after a baby has reached 12 weeks of gestational development and has banned transgender surgeries and hormone treatments for minors since Governor Jim Pillen signed it into law on May 22, 2023.
