Mother of man killed by off-duty Lafayette Police officer files wrongful-death lawsuit

LAFAYETTE, La. (KLFY) -- The mother of a man shot and killed outside a Lafayette nightclub by an off-duty police officer is suing Lafayette Consolidated Government, among others.

On April 8, Elsie Solomon, parent of the deceased Deiondre Solomon, filed a Petition for Damages for Wrongful Death and Survival in the 15th Judicial District Court, court records show. The case has since been moved to federal court.

Deiondre Solomon, 28, of Lafayette, was shot and killed by off-duty Lafayette Police officer Clayton Green, who was working a security detail near the La Bamba nightclub in Lafayette in April 2023, court records show.

The suit names LCG, Green, La Bamba and the Lafayette Municipal Fire and Police Board as defendants.

According to police, Green shot Deiondre Solomon after allegedly witnessing Solomon shooting another person.

"The use of gunfire was an unwarranted, excessive use of force contrary to the laws of the State of Louisiana and the United States of America," the suit alleges. "The officer acted with wanton disregard for human life."

The suit alleges that Green was "suffering from postraumatic stress disorder or some other mental illness due to a recent life experience" that rendered him "unfit to perform police duties."

The suit also alleges that La Bamba was partly responsible.

"The owner and operator of the venue were aware of or should have been aware of the extreme propensity for violence during events at this venue and failed to take adequate measures to ensure the safety of persons," the suit reads.

Finally, the suit claims that infighting between LPD and the Municipal Fire and Police Board was a contributing factor in the shooting.

"The dysfunctionality of the agencies involved are proximate cause of the shooting death" of Solomon, the suit alleges.

No trial date has been set.
