'Unlike anything I've ever seen': Expert says 'garbage' in Trump filing warrants sanctions

A former federal prosecutor Saturday highlighted the purported hypocrisies associated with the actions of Judge Aileen Cannon, who is overseeing Donald Trump's criminal Espionage Act case in Florida.

Glenn Kirschner, who frequently appears on MSNBC as a legal analyst, explained that Special Counsel Jack Smith filed a gag order request back in May, but that it still hasn't been answered by Cannon.

"Judge Cannon has yet to rule on that motion back in May, a narrow restriction... designed to protect law enforcement," he said in a video for "Justice Matters."

Yet in 24 hours, Kirschner said, Cannon granted Trump's motion seeking a delay in the case to figure out what the Supreme Court's immunity ruling means for the criminal case.

Then, Kirschner highlighted something that is "unlike anything" he's ever seen included in any court filing from defense or prosecutors.

"Donald Trump's lawyers include in this filing stuff that is ripped right from Donald Trump tweets," he said, quoting the filing as saying Special Counsel Jack Smith "seeks to subvert the upcoming election." He then notes that the brief calls President Joe Biden's debate performance "exceedingly week."

"That kind of crap has no place in a court filing - it has no relevance to any legal issue in the motion," he said, adding that a "self-respecting judge" would strike the language from the record and potentially hit Trump's attorneys with a show cause hearing to convince the court that they shouldn't be sanctioned for that "unprofessional and potentially unethical conduct."

"You think we'll hear a peep out of Judge Cannon about the garbage that Donald Trump's attorneys put in this court filing?" he asked, saying it was an attempt to "convert a court filing into a campaign ad."
